The Digital Millennium Copyright Act (“DMCA”), enacted in 1998, provides copyright owners with a legal process to address unauthorized use of their protected works online under U.S. copyright law. usil.mobi.ng follows the policy below to respond to copyright infringement claims in compliance with the DMCA.
Our Commitment to Copyright Protection
usil.mobi.ng treats all copyright complaints with seriousness. If you genuinely believe that content hosted on usil.mobi.ng violates your copyright, you may submit a formal written notice of alleged infringement to the website’s designated contact listed at the end of this policy.
Requirements for a Valid DMCA Takedown Notice
The DMCA outlines specific criteria for submitting a valid infringement notice (see 17 U.S.C. § 512(c)(3)). To be considered valid, your written notification must include all of the following:
- A physical or electronic signature of the copyright owner, or an authorized representative
- Clear identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material, along with sufficient details to help us locate it
- Adequate contact information for the complaining party, including address, telephone number, and email address if available
- A statement confirming a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement affirming that the information provided is accurate and, under penalty of perjury, that the notifier is authorized to act on behalf of the copyright owner
Actions Taken After Receiving a Valid Notice
Upon receipt of a proper and complete infringement notice, it is our standard practice to:
- Remove or restrict access to the content alleged to be infringing
- Inform the relevant contributor or user that the material has been removed or disabled
- Take appropriate action against repeat offenders, which may include restricting access to the website
False Claims and Legal Consequences
Please note that submitting false or misleading claims may result in legal consequences under applicable copyright laws.
Counter-Notification Process
If you believe your content was wrongly removed due to an error or misidentification, you may file a counter-notification. A valid counter-notification must be a written submission containing:
- Your physical or electronic signature
- Identification of the material that was removed or disabled, including its original location before removal
- A statement, made under penalty of perjury, asserting a good-faith belief that the content was taken down due to a mistake or misidentification
- Your full name, address, and telephone number, along with a statement consenting to the jurisdiction of the appropriate legal authority and agreeing to accept legal service from the original complainant
